1. Acceptance of Terms

By accessing or using WebFold, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our service.

2. Description of Service

WebFold is a SaaS platform that enables users to create and host websites using Google Docs as a content management system. We provide:

• Website generation from Google Docs content
• Website hosting on our platform or custom domains
• Theme selection and customization tools
• Static website delivery via CDN
• Storage for website assets and content

3. Account Registration

To use WebFold, you must:

• Sign in with a valid Google account
• Grant necessary permissions to access your Google Drive and Google Docs
• Provide accurate and complete information
• Be at least 18 years old or have parental/guardian consent
• Maintain the security of your account credentials

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Service Plans and Billing

4.1 Free Tier

• 1 website on platform subdomain ({website-slug}.webfold.io)
• 25MB storage limit
• Platform branding ("Powered by WebFold")
• 30-day inactivity expiry (websites are automatically deleted after 30 days without updates)

4.2 Starter Tier ($7/month or $60/year)

• 1 website with custom domain support
• 100MB storage limit
• No platform branding
• Websites never expire
• Nested navigation support

4.3 Payment Terms

• All payments are processed securely through Stripe
• Subscriptions are billed monthly or annually in advance
• Annual plans are billed as a single payment and non-refundable
• Prices are in USD and may be subject to change with 30 days notice
• Failed payments may result in service suspension
• No refunds for partial months or unused service time

5. Fair Use Policy

While we offer unlimited bandwidth for normal website traffic, the following uses are strictly prohibited:

• Cryptocurrency mining
• File hosting or file sharing services
• Video streaming platforms
• Proxy or VPN services
• DDoS attacks or network abuse
• Automated scraping or bot traffic designed to consume resources

We reserve the right to suspend or terminate accounts that violate this fair use policy without prior notice or refund.

6. Content Ownership and License

6.1 Your Content

You retain all ownership rights to the content you create and publish through WebFold. By using our service, you grant us a limited license to:

• Access your Google Docs to generate website content
• Store and host your website content on our infrastructure
• Display your website to visitors
• Make technical copies necessary for backup and service operation

This license terminates when you delete your website or cancel your account.

6.2 Your Responsibilities

You are solely responsible for the content you publish. You represent and warrant that:

• You own or have the necessary rights to all content you publish
• Your content does not infringe on any third-party intellectual property rights
• Your content complies with all applicable laws and regulations
• Your content does not contain malware, viruses, or malicious code

7. Prohibited Content

You may not use WebFold to create or host websites containing:

• Illegal content or content that promotes illegal activities
• Content that infringes on intellectual property rights (copyright, trademarks, patents)
• Hate speech, harassment, or discriminatory content
• Child sexual abuse material (CSAM) or child exploitation content
• Adult content or pornography
• Malware, viruses, or malicious software
• Phishing schemes or fraudulent content
• Content that violates privacy rights or contains doxxing
• Spam or unsolicited commercial content

We do not proactively monitor user content, but we respond to reports and reserve the right to remove content and suspend accounts that violate these terms.

8. Google API Integration

WebFold uses Google Drive API and Google Docs API to access your content. By using our service, you acknowledge that:

• We will only access the Google Drive folders and documents you explicitly select
• Your Google access tokens are stored encrypted in our database
• You can revoke WebFold's access to your Google account at any time through your Google Account settings
• Revoking access will prevent your website from updating but will not delete existing published content

Our use of Google user data complies with the Google API Services User Data Policy, including the Limited Use requirements.

9. Custom Domains

If you use a custom domain with WebFold:

• You must own or have authorization to use the domain
• You are responsible for maintaining domain registration and DNS configuration
• SSL certificates are automatically provisioned via Let's Encrypt
• We reserve the right to refuse custom domains that are misleading, infringe trademarks, or violate our policies
• Domain verification is required before SSL provisioning

10. Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted or error-free service
• Any specific uptime percentage
• That our service will meet your specific requirements
• That defects will be corrected immediately

We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time with or without notice. Planned maintenance will be communicated when possible.

11. Data Retention and Deletion

When you delete a website or cancel your account:

• Your website content and associated data are deleted immediately from our active systems
• Backups may retain your data for up to 90 days for disaster recovery purposes
• We are not responsible for maintaining copies of your content after deletion
• You are responsible for exporting or backing up your content before deletion

Free tier websites are automatically deleted after 30 days of inactivity (no updates to content or settings).

12. Cancellation and Termination

12.1 Your Rights

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Paid subscriptions remain active until the end of the current billing period
• No refunds are provided for partial months or unused service time
• Your website and data will be deleted at the end of the billing period

12.2 Our Rights

We reserve the right to suspend or terminate your account immediately without prior notice or refund if:

• You violate these Terms of Service
• You violate our Fair Use Policy
• Your content violates our Prohibited Content policy
• Your account is used for fraudulent or illegal activities
• Your payment method fails or is declined
• We are required to do so by law

13. Intellectual Property

The WebFold service, including all software, designs, text, graphics, logos, and trademarks, is owned by VOLOȘCIUC EUGEN PERSOANĂ FIZICĂ AUTORIZATĂ and protected by Romanian and international intellectual property laws. You may not:

• Copy, modify, or distribute our software or service
• Reverse engineer or attempt to extract source code
• Remove or modify any copyright or trademark notices
• Use our trademarks without written permission

14. Third-Party Services

WebFold integrates with third-party services including:

• Google Drive and Google Docs (content source)
• Stripe (payment processing)
• Cloudflare (CDN and DNS)

Your use of these services is subject to their respective terms and policies. We are not responsible for the practices or policies of third-party services.

15. Limitation of Liability

To the maximum extent permitted by law:

• WebFold is provided "as is" and "as available" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for data loss, business interruption, or lost profits
• We are not responsible for content published by users or third-party services

Some jurisdictions do not allow limitations on implied warranties or liability, so some of the above limitations may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless VOLOȘCIUC EUGEN PERSOANĂ FIZICĂ AUTORIZATĂ from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your content or websites
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property or privacy rights

17. DMCA and Copyright Complaints

We respect intellectual property rights. If you believe content hosted on WebFold infringes your copyright, please contact us at support@webfold.io with:

• Identification of the copyrighted work
• URL of the infringing content
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

We will investigate and take appropriate action, which may include removing the content and terminating repeat infringers' accounts.

18. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of Romania. Any disputes arising from these terms or your use of WebFold shall be subject to the exclusive jurisdiction of the courts of Romania.

If you are a consumer in the European Union, you also have rights under EU consumer protection laws, and nothing in these terms affects those rights.

19. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective:

• Immediately upon posting for non-material changes
• 30 days after notification for material changes

We will notify you of material changes via email or prominent notice in the dashboard. Your continued use of WebFold after changes take effect constitutes acceptance of the new terms.

20. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

21. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and VOLOȘCIUC EUGEN PERSOANĂ FIZICĂ AUTORIZATĂ regarding your use of WebFold.
